Can benefit be backdated?
Benefit can be backdated for a maximum of 52 weeks prior to the date the claim was received providing there are good reasons why that claim could not be made earlier and those reasons last throughout the whole time until the date the claim was made.
How do I request that my claim be backdated?
- You will need to write to the Benefits Office giving the date that you want you claim backdating to and the reasons why you were unable to make your claim earlier.
- You will need to confirm that the reasons last throughout the whole period you are asking for your claim to be backdated.
- You may be asked to provide evidence of your reasons for example, a letter from your doctor confirming any medical reasons.
- If you are married or live with a partner you will need to give the reasons why they were also unable to send in your claim form earlier.
How will I know if my claim has been backdated?
- You will be able to tell if your claim has been backdated from your notification letter which will tell you the date your claim has been paid from.
- If you ask for a backdate after you have already received your notification letter we will write to you separately about our decision.
What if my claim is not backdated?
- If your claim is not backdated and you want further information you can telephone the Appeals Team who will talk to you about the decision.
- You can write to the Appeals Team asking them for further information about the decision.
- You can appeal against the decision providing you do so in writing within 1 calendar month of the date you were sent your notification letter but you must give the reasons why you do not agree in your letter.
