Licensing
Enforcement Officers actively enforce the
provisions of the law and local conditions,
in relation all of the licensing functions
that the service oversees. For example,
this could include a private hire driver
who commits the offence of plying for hire
or fails to wear his/her identification
badge, or a hackney carriage driver who
overcharges his/her customers.
Other matters
could include the obstruction of an
authorised officer, a failure to comply
with the request from such an officer or
providing false details or information to
officers. Some of these offences carry large fines
and/or endorsements on a driving
licence. In many occasions, licencees who
continually break the rules and the law
will be reported to the Licensing Board,
where Members may decide to suspend, revoke
or non-renew a licence. The Licensing Enforcement team
must comply with all rules of evidence,
home office guidelines and the Council's
own 'General Enforcement Policy' to ensure
consistency and fairness. In any case
presented before a Magistrate or Crown
Court the prosecution must prove beyond all
reasonable doubt that the offence charged
was committed by the defendant. This means
that in all cases the Council's officers
must ensure that they have followed up all
reasonable lines of enquiry and that the
matter has been processed efficiently and
within strict guidelines and time limits.
