Preventing a New Route

Preventing a route being added to the definitive map and statement

The majority of rights of way come into being as a result of user evidence. If a route has been used for a period of 20 years or more without let or hindrance, the way is deemed to have been dedicated by the landowner.

However there may be evidence which shows that the landowner had no intention to dedicate. This could be an interruption of the public's use of the way which can be shown to have been effective in preventing the public using the way e.g. the landowner can erect notices stating that the way is private.

Alternatively the landowner can deposit a Statutory Declaration with the Highway Authority.

 Statutory Declarations
