What and when is enforcement action taken:
Enforcement action is taken in accordance with the Council's General Enforcement Policy. Each case is unique and is considered on its own facts and merits. However, when making decisions we take account the advice set out in the Director of Public Prosecutions Code for Crown Prosecutors
The factors which are taken into consideration include:
- The seriousness of the alleged offence
- The past record
- The willingness to prevent a recurrence to prevent a recurrence of the problem or put right the harm
- Whether the offence was carried out deliberately or with reckless disregard of the law
- The views of the complainant and other parties with an interest in the case.
What this means to You:
If the prosecution is successful the court may impose fines and possibly imprisonment.
