Carers' rights
Carers in England are supported by a range of legislation that recognises their vital role and provides rights to assessment, support, and protection. These laws apply to adult carers, young carers, and parent carers, and cover both social care and employment rights.
The Right to Unpaid Carer’s Leave
From 6 April 2024, under the Carer’s Leave Act, employees now have the legal right to take up to 5 days of unpaid leave per year to care for a dependant with a long-term care need. This is a “day one” right, meaning it applies from the first day of employment.
The Right to Request Flexible Working
Thanks to the Employment Relations (Flexible Working) Act, all employees—including carers—can now request changes to their working hours, location, or pattern from day one of employment. You can also make two requests per year, and employers must respond within two months.
The Right to Be Identified as a Carer by Your GP
You can ask your GP practice to record you as a carer on your medical record. This can help ensure you’re prioritised for public health campaigns, such as vaccinations, and may give you access to additional support.
The Right to a Free Flu Jab
If you receive Carer’s Allowance or are the main carer for someone who would be at risk if you became ill, you are entitled to a free flu vaccination. Speak to your GP or local pharmacist to arrange this.
Protection from Discrimination
Under the Equality Act 2010, carers are protected from discrimination or harassment because of their association with a disabled person. This applies in the workplace and when accessing goods or services.
The Right to a Carer’s Assessment
If you’re over 18 and provide regular unpaid care, you have the right to a carer’s assessment from your local authority. This looks at how caring affects your life and what support you might need—regardless of the amount or type of care you provide.
The Right to Be Consulted on Hospital Discharge
If the person you care for is being discharged from hospital, the NHS must identify and consult with you, where possible. This ensures you’re involved in planning and that the right support is in place before they return home.
