Right of Access

Information you should be aware of when submitting a request

The Council has one month to respond to a request for access to personal information from the date a verified request is received (i.e. application form and acceptable copies of identification).

We may extend this by up to two months where a request is complex or where the request involves multiple data subjects. If we require an extension we will inform you as soon as possible and no later than one month following receipt of the request. We will also inform you why the extension is required.

It may be necessary to redact certain details from the information which is provided in response to your request, such as third-party information. You can find more information on the type of details which will be redacted at the link below:

RMBC may refuse or in exceptional circumstances charge a ‘reasonable fee’ where a request is manifestly unfounded (e.g. excessive or repetitive).

This will be assessed on a case by case basis and if we feel it is necessary to charge for the provision of information we will contact you prior to proceeding with your request. In these cases we will not commence the request until the fee is received.

If you are unsatisfied with redactions made to the information provided you are entitled to ask for a review of the decision. To request a review please see the process below.
