Information you should be aware of when submitting a request

Please be aware that the Right to Restrict Processing only applies in the following circumstances:

  • Where you contest the accuracy of the personal data, Rotherham MBC will restrict the processing until we have verified the accuracy of the personal data.
  • Where an individual has objected to the processing (where it was necessary for the performance of a public interest task or purpose of legitimate interests), then the organisation needs to determine whether it has legitimate grounds to override the request to restrict that processing.
  • When processing is unlawful and you oppose erasure and request restriction instead.
  • If Rotherham MBC no longer need the personal data, but you require the data to establish, exercise or defend a legal claim.

The Council has one month to respond to a request in relation to the Right to Restrict Processing from the date a request is verified (i.e. application form and acceptable copies of identification).

If RMBC fulfils your request then we will retain the least amount of information, in relation to your request, as possible. This will ensure that the restriction is respected and adhered to in future. However, it may be necessary to retain a note of your request, as a record that a request to undertake this action was made.
