Dealing with contaminated land

Contaminated land must be considered when either planning a development or when buying or selling a house/land. Most issues relating to contaminated land can be dealt with via the planning regime, or through the Enforcement of Part IIA of the Environmental Protection Act 1990.

Contaminated Land Strategy

Rotherham Council is responsible for implementing the Contaminated Land Regulations. The Council has a duty to inspect land to identify where historical contamination may pose a significant risk to people or the environment. As part of this duty, the Council will inspect land from time to time, for the purposes of:

  • Identifying Contaminated Land
  • Identifying any sites which are required to be designated as Special Sites

A Contaminated Land Strategy has been prepared in accordance with Part IIA of the Environmental Protection Act 1990. The Contaminated Land Strategy contains more information on how and when we will inspect land and what to do if we need to designate land as ‘contaminated land’. The Council will then decide if remediation works are required and who will need to deal with the contamination.
