Right to Erasure

Information you should be aware of when submitting a request

The Council has one month to respond to a request for personal information to be erased from the date a verified request is received (i.e. application form and acceptable copies of identification).

RMBC may contact you upon receipt of your request in order to obtain further information from you to identify the records you are requesting to be erased.

There are several reasons why the authority may refuse to comply with a request for information to be permanently deleted, these include the following:

  • to exercise the right of freedom of expression and information;
  • to comply with a legal obligation for the performance of a public interest task or exercise of official authority;
  • for public health purposes in the public interest;
  • archiving purposes in the public interest, scientific research historical research or statistical purposes; or
  • the exercise or defence of legal claims.

If RMBC agree to the erasure of personal information we will also contact any third parties with whom this information has been shared. This will be to inform them of the change, unless it would be deemed impossible or involve disproportionate effort to do so.

Please note that if RMBC complies with your request then a record will be kept containing brief details of the information permanently deleted for future reference.
