Making a request for Information to be Erased

Use the form below to submit a request for personal information held by RMBC to be erased.

We ask that you provide as much detail as possible such as:

  • your full name and current address;
  • contact email and phone numbers;
  • any previous names and contact addresses;
  • date of birth;
  • proof of identity.

Proof of identity should be two official documents which show your date of birth, name and current address such as a current driver’s licence, current passport, utility or council tax bill (within 3 months) etc. Please do not send original documents, good quality copies are adequate. The one month timeframe for us to complete your request will start from the day after we receive and verify your identification.

If you wish, you can appoint someone you trust to act on your behalf. If you are applying to request someone else’s records are erased you will need to enclose their signed permission or other legal documentation (e.g. Parental Responsibility or Power of Attorney) to confirm their request. If we have any queries regarding your received request or identification we will contact you prior to proceeding with your request.

Please describe the information that you are asking to be deleted in as much detail as possible. It will also assist us if you can provide the timeframe that the information you are referring to covers. Please note that the Right to Erasure does not provide an absolute ‘right to be forgotten’, there must be specific circumstances for this to apply such as the following:

  • Where the personal data is no longer necessary in relation to the purpose for which it was originally collected/processed.
  • When the individual withdraws consent.
  • When the individual objects to the processing and there is no overriding legitimate interest for continuing the processing.
  • The personal data was unlawfully processed (ie otherwise in breach of the GDPR).
  • The personal data has to be erased in order to comply with a legal obligation.

You must specifically state in your request why you feel the information should be erased. If you do not give a reason your request is likely to be refused.

It may be necessary for us to contact you for further information if you do not supply us with sufficient details to locate the information you are referring to.
