Subletting Your Property

You do have the right to rent your property out and do not need to ask our permission.

However, you must let us know that the property is being rented out otherwise we will not be able to manage the block effectively and we may not be able to get in touch with you in an emergency. Failing to let us know would be considered to be a breach of your lease and there may be implications in respect of the buildings insurance.

If you have a mortgage, you must also let your mortgage lender know as some may not permit sub-letting.

It is also important that you understand that when you rent out your property you become their landlord and you will be creating a tenancy. You must make sure that your tenant does not do anything which could be considered a breach of your lease, for example; by causing nuisance or Anti-Social Behaviour to other residents – you would be held responsible if this occurs.

For this reason, you should make sure that you have a clear, written tenancy agreement in place which gives you appropriate recourse to deal with any problems caused by your tenants, including taking court action against them and removing them from the property.
