Licence for Streetworks (Section 50 licence)
Any organisation wishing to excavate and install or maintain any apparatus in the public highway not being a statutory undertaker must obtain a licence under Section 50 of the New Roads and Streetworks Act 1991.
Apparatus in this context may include:
- any equipment, pipework, ducting, culvert, tunnel, cabling or other such connecting plant or conduit
- as well as associated chambers, valves, junction boxes poles or
- any other equipment required to transmit, convey or facilitate the connection of services or
- in some cases, products such as liquids, effluent, gas, heat, electricity, telecommunications, powders, oils, and gels
A person granted a street works licence becomes an undertaker for the purposes of the New Roads and Street Works Act 1991 and attracts the relevant duties and responsibilities imposed by the Act and associated Secondary Legislation and Codes of Practice.
Financial penalties will be imposed by the Street Authority against the licence holder for non-compliance with the relevant statutory duties or licence conditions. Applicants should note that this liability cannot be delegated to any other person or organisation.
The current fee for a standard section 50 license per each affected street is £700 for the first fifteen days of any works with a supplement charge of £109.50 for each subsequent 15 days.
