General Enforcement Policy

2. Purpose of the policy

The Policy will be published on the internet. Relevant service standards and function specific Enforcement Policies drawn up by each individual service area, will be available in electronic or paper format upon request. 

  1. In working to the Policy its purpose will ensure public protection, legal compliance and set the framework within which officers of the Council will operate, enforce and ensure regulatory compliance.
  2. All officers will have regard to this document when making enforcement decisions. Any departure from this policy must be exceptional, capable of justification and be fully considered by the Director of service before a final decision is taken.
  3. This provision shall not apply where a risk of injury or to health is likely to occur due to a delay in any decision being made. In cases of emergency or where any exceptional conditions prevail, the Chief Executive may suspend any part of this policy where necessary to achieve effective running of the service and/or where there is a risk of injury or to health of employees or any members of the public. Section 6.4 of the Regulators’ Code requires regulators to have mechanisms in place to ensure that their officers act in accordance with their published service standards, including their enforcement policy.
